Flatsharing
What are the rules for sharing a flat?
What the law says
- A flatshare needs the landlord’s express agreement, a single written lease and a flatshare pact signed no later than the lease; at least one room or bathroom must be shared (Art. 2bis).
- The pact covers at least how rent and charges are split, an inventory of furniture, arrivals and departures, the deposit and how disputes are settled (Art. 2ter).
- A flatmate who leaves gives three months’ notice, at the same time to the landlord (by registered letter) and to the others (Art. 2quinquies).
- They must look for a replacement during the notice; an ad in two Luxembourg property media within 15 days counts as an active search (Art. 2quinquies).
Watch out for
- A married couple or registered partners are not a flatshare (Art. 2bis).
- When a flatmate leaves, an interim check-out report is mandatory (Art. 2ter).
