Bullying at work (moral harassment)
What does the law say, and am I protected if I complain?
What the law says
- Moral harassment is any repeated or systematic conduct that harms a person’s dignity or mental or physical integrity, including messages outside working hours (Art. L. 246-2).
- The employer must stop any harassment they know about immediately, and the measures must not work against the victim (Art. L. 246-3).
- No retaliation against an employee who protests or testifies; a retaliatory dismissal is void (Art. L. 246-4).
Watch out for
- If you are dismissed in retaliation, you have 15 days to ask the president of the labour court to declare it void (Art. L. 246-4).
- Keep a written record: dates, messages, witnesses.
