My landlord wants the home back

Can the landlord end the lease, and with how much notice?

What the law says

  • A lease that reaches its end is extended for an indefinite period, unless the landlord needs the home for themselves or a relative up to the 3rd degree, the tenant does not meet their obligations, or there are other serious and legitimate reasons (Art. 12).
  • Selling the home is not a serious and legitimate reason (Art. 12).
  • To move in themselves, the landlord must give six months’ notice (Art. 12).
  • The letter must be written, give reasons, be sent by registered post with acknowledgement of receipt, and quote the text of this paragraph of the law, or it is void (Art. 12).

Watch out for

  • Within three months of the acknowledgement of receipt, you can ask the justice of the peace for more time; after that, the right is lost (Art. 12).
  • The extension cannot go beyond twelve months after the initial six months, and you must show what you have done to find a new home (Art. 12).
