Something you bought breaks: the legal guarantee
How long is the seller responsible for a defect?
What the law says
- The seller is responsible for any defect that existed on delivery and shows up within two years (Art. L. 212-5).
- A defect that shows up in the first year is presumed to have existed on delivery, unless the seller proves otherwise (Art. L. 212-5).
- For second-hand goods the guarantee can be shortened by contract, but never below one year (Art. L. 212-5).
- For a used car, that shortening is only valid if it was first registered more than a year ago (Art. L. 212-5).
Watch out for
- Keep the invoice: it proves the delivery date that starts the two years.
