Overtime

How is overtime compensated?

What the law says

  • Each hour of overtime earns 1 hour 30 minutes of paid time off, or the same rate on a time-savings account (Art. L. 211-27).
  • If time off is impossible for organisational reasons, or you leave the company first, each hour is paid at your hourly wage plus 40% (Art. L. 211-27).
  • That 140% is free of tax and social contributions, except the health-care contribution on the un-increased hour (Art. L. 211-27).
  • Hourly wage = monthly wage divided by 173 hours (Art. L. 211-27).

Watch out for

  • A collective agreement can set the details: check yours (Art. L. 211-27).
