My landlord is raising the rent

How often, and by how much, can rent go up?

What the law says

  • Yearly rent may not exceed 5% of the capital invested in the home (Art. 3).
  • Rent can only be adjusted once every two years (Art. 3).
  • The two-year period keeps running when the landlord changes; it ends when the tenant changes (Art. 3).
  • An increase may not exceed 10% (Art. 3).

Watch out for

  • If the increase is above 10%, send the landlord a complaint by registered letter: the part above 10% is no longer due from the next rent payment (Art. 3).
  • If you disagree on the rent amount, you can take it to your commune’s rent commission (commission des loyers) (Art. 5 and 8).
