The trial period
How long can it last, and how does it end?
What the law says
- A trial period is only possible in a permanent contract and must be in writing at the latest on your first day; without it, the contract is permanent from the start (Art. L. 121-5).
- It lasts between two weeks and six months (Art. L. 121-5).
- At most three months below the CATP vocational level; up to twelve months above a salary set by grand-ducal regulation (Art. L. 121-5).
- It cannot be renewed (Art. L. 121-5).
Watch out for
- During the first two weeks, neither side can end it, except for serious misconduct (Art. L. 121-5).
- After that, notice is at least as many days as the trial has weeks, or four days per month of trial, at least fifteen days and at most one month (Art. L. 121-5).
- If nobody ends it before the trial is over, the contract becomes permanent (Art. L. 121-5).
