An unpaid bill

What happens if I do not pay a bill?

What the law says

  • When a consumer owes money to a business, the bill automatically earns interest at the legal rate from the end of the third month after delivery, the work or the service (Art. 12).
  • That interest is only due if the business sent the invoice within one month, stating that it intends to apply Article 12 (Art. 13).
  • The legal interest rate is set every year by grand-ducal regulation (Art. 14).
  • If you can no longer cope with all your debts, there is an over-indebtedness procedure (law of 8 January 2013): see the guide “I cannot pay my debts any more”.

Watch out for

  • Check the date and wording of the invoice: they decide whether interest is due (Art. 13).
  • Talk to the creditor early: a negotiated payment plan often costs less than a procedure.
